or other similar considerations.  The Tenth Schedule was inserted in the Constitution in 1985. It lays down the process by which legislators may be disqualified on grounds of defection by the Presiding Officer of a legislature based on a petition by any other member of the House.

Criticism of the Anti defection:

  1. It does not differentiate between dissent and defection.
  2. Brought bossism in the party.
  3. Differentiation between independent member and nominated member is illogical.
  4. It fails to regulate the behaviour of the members outside the Parliament.
